Graphics Visual & Text Evidence:  RDADS Patent vs. MDM Software Inventions

Side-by-Side Comparison:  Screen Shots, Architecture & System Diagrams

 

·    On March 22, 2007, the patent application for RDADS invention was published by the US Patent & Trademark Office.

·    The patent application [text & diagrams] proves 2005 RDADS invention is actually the 2002 MDM software inventions.

 

The following sections below provide clear visual evidence that Battelle renamed 2002 MDM inventions to

RDADS after calling the MDM-on-BlackBerry version “new code” in 2005 [misrepresentation to patent office]:

                     RDADS copied [lifted] the MDM screen graphics/layout that Pulver solely wrote for MDM TAP project in 2002.

                 Text of application (program flow, logic, purpose/benefit, specific words/phrases) is directly lifted from the

                 2002 MDM software inventions, the November 2002 MDM product specification, and other MDM documents. 

                 In his deposition, Shoemaker testified that the 2005 RDADS patent claims apply to 2003 MDM/PDAC.

The RDADS & MDM control panel screens are identical, except RDADS has the critical “drill down category mechanism” that Battelle’s 8-1-03 TAP report (GES-00202) clearly stated was developed for MDM.  This DOE-funded functionality is missing from the 8-29-03 version delivered to Pulver; see MDM screen at right.

In 2008, Battelle cited no evidence refuting their withholding this functionality

[which violates False Claims Act 31 USC §3729]; see Documents [#1] section for details.

MDM Version Delivered on 8-29-03 Funded by DOE-TAP - See KED-01387

This screen confirms Battelle removed TAP-funded “drill down” prior to delivering MDM to Pulver. 
“Drilldown” was critical
& necessary for handheld catalogs; in May 2003, Battelle was marketing MDM as a handheld catalog sales automation solution to Ecolabs, a major opportunity for their private (1831) business. Removing ‘drill down” from 8-29-03 MDM blocked Pulver from pursuing handheld catalog markets; exhibits show Battelle promoted MDM with this functionality KED-00880.

Documents show the RDADS output screen is virtually identical to MDM screen interface design
and the RDADS software program name is
"MobileDM", is the Mobile Data Manager name.

to Battelle-PNNL during the 2002-2003 DOE-funded TAP project:
KED-00276 & KED-00613]

RDADS is the unauthorized use of MDM graphics-design developed by Pulver. 

Note:  Battelle’s misappropriation of the Pulver’s MDM graphics/design in the patent-pending RDADS software violates the DOE-funded technical assistance program [TAP].  

Section 6 in the signed TAP agreement states:

“Neither Battelle nor the DOE shall acquire any rights in any information disclosed to BATTELLE hereunder unless BATTELLE can prove that such information (i) was already in possession of BATTELLE prior to disclosure by REQUESTOR, or (ii) was independently developed by BATTELLE without reference to REQUESTOR’S information, or (iii) is or becomes a part of the public domain.  The Parties recognize that the U.S. Government shall have certain rights in any information generated by BATTELLE hereunder, but such rights shall not preclude REQUESTOR’S use of such information.”
